License and Update Permission Time
License Data
The data of the licensee are contained in the file "yourlicense.lic", protected by a binary code. This file must be present in the Match! program directory; otherwise, Match! will refuse operation. The main license data are displayed on the right-hand side of the status bar at the bottom, as well as on the splash screen which opens when Match! is executed. You can view the full license data as well as information about your update permission time (see below) in the "About Match!" window which can be opened from the "Help" menu (application menu on the Mac).
In the same window, you can also determine the version of Match! you are currently using. This information is helpful if you would like to check for updates on the corresponding web page.
License Agreement
By installing Match!, you have accepted the following license agreement:

between you and Crystal Impact
Grant of License: This Software Product is owned by Dr. H. Putz & Dr. K. Brandenburg GbR
("Crystal Impact") or by its successors, and is protected by copyright law and
international treaty provisions. This agreement does not provide you with title or
ownership of the Software Product, but only a right of limited use. If you have
acquired one or more special licenses "for use in academic institutions only", you are
restricted to use these licenses at schools, universities, or other non-commercial
researching and educational institutions, exclusively.
Restrictions:
- Number of users: The number of installations at a time depends on the license
type:
- For single and personal licenses, the number of installations is limited to the number of
licenses you have purchased. You are not allowed to install the Software Product
on a file server for being used by more than one person per license at a time.
However, the person that is using a single or personal license is allowed to also install and use the Software
Product on a second computer (e.g. a laptop in addition to an office computer). A single or personal license must
not be installed on a file server.
- In case you purchased a site license, you can install the Software Product on an
unlimited number of PCs within one institute or department. You are also allowed to
install the
Software Product on a file server if access to the program is limited to the corresponding
institute or department.
- If you have purchased a campus license, you can install the Software Product on an
unlimited number of PCs within one university or company. You are also allowed to
install the
Software Product on a file server if access to the program is limited to the corresponding
university or company.
- Reverse Engineering: You are not permitted to disassemble or reverse compile the
Software Product for the purpose of reverse engineering.
- Copying: You are not permitted to forward copies of the Software Product to any third
person. Copies of the Software Product may be made for personal archival or backup purposes
only.
- Rental or Leasing: You are not permitted to rent or lease the Software Product.
- Alienation: You are permitted to alienate the Software Product, only in whole but not
in part, provided that you have destroyed all backup copies of the Software Product, and the
new user will conclude a license agreement with Crystal Impact without additional
royalty.
- Copyright of Data: Diffraction patterns and other data calculated from copyrighted material/crystal
structures may only be used in agreement with the copyright of these source data.
Crystal Impact shall not be liable for any copyright violations of users of the
Software Product!
Copyright: All title and copyrights in and to the Software Product, the accompanying printed
materials, and any copies of the Software Product, are owned by Crystal Impact or its
successors. The Software Product is protected by copyright laws and international
treaty provisions. Therefore, you must treat the Software Product like any other
copyrighted material except that you may make one copy of the Software Product solely
for backup or archival purposes.
Limited Warranty: This Software Product is provided "AS IS" without
warranty of any kind either expressed or implied, including but not limited to the
implied warranties merchantibility and fitness for a particular purpose. The entire
risk as to the quality and performance of the Software Product is with you.
Crystal Impact does not warrant that the functions contained in the Software Product
will meet your requirements or that the operation of the software will be
uninterrupted or error free.
Limitation of Remedies and Liability: In no event shall Crystal Impact,
or any other party who may have distributed the Software Product as permitted above,
be liable for damages, including any general, special, incidental, or consequential
damages, arising out of the use or inability to use the Software Product (including,
but not limited to, loss of data or data being rendered inaccurate or losses sustained
by you or third parties or failure of the Software Product to operate with any other
products), even if such holder or other party has been advised of the possibility of
such damages.
The cumulative liability of Crystal Impact to you for all claims relating to the
Software Product, in contract, tort, or otherwise, shall not exceed the total amount
of license fees paid to Crystal Impact for the relevant Software Product. The
foregoing limitation of liability and exclusion of certain damages shall apply
regardless of the success or effectiveness of other remedies.
- Update permission time: Along with your purchase of a license you also obtain the right to get all updates and new versions of the software product free-of-charge within a limited amount of time (called your "update permission time"). You can get information about your current update permission time period by running the "Help/About Match!" command in the software.
A 3-year update permission time is included automatically when you purchase a new license. Additional update permission time can be purchased directly along with the new license or separately sometime later on.
- Usage time: You can use your current software version as long as you like (provided that you have purchased a permanent license). The ability to install and use updates depends on your update permission time, however.
- Updates: Within a limited amount of time, you can download and install all updates and new versions free-of-charge. Updates of versions that are released after your update permission time has expired cannot be installed and run. If you would like to use these more recent versions, you have to purchase an extension for your update permission time.
- Interrupt of update permission time: Purchasing subsequent update permissions is not mandatory: You can stop purchasing extensiions of your update permission for some time (remember that you can use the software versions that have been released within your update permission time as long as you like), and purchase a new update permission time later on when you feel that recent improvements of the software are of interest for you again.
